These Terms and Conditions ("Terms") govern your access to and use of the website oxytower.in (the "Site") and your purchase of any products sold by Oxy Tower ("Oxy Tower," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.

 

ABOUT OXY TOWER:

 

Oxy Tower designs and sells premium, handcrafted home decor and lifestyle products, including living moss air purifiers, manufactured in India. Our registered contact details are provided in the "Contact Us" section below.

 

ELIGIBILITY:

 

You must be at least 18 years old, or using the Site under the supervision of a parent or legal guardian, to place an order. By using the Site, you confirm that the information you provide to us is accurate and current.

 

PRODUCTS AND PRODUCT DESCRIPTIONS:

 

We make every effort to describe and display our products accurately, including materials, dimensions, and features. However, because Oxy Tower incorporates a living, natural moss component, slight variation in moss color, density, and appearance between units is normal and expected, and is not considered a defect.

 

Product images are for illustrative purposes. Actual colors and finishes (including the marble-look base) may vary slightly due to the handcrafted nature of each piece and differences in screen display settings.

 

We reserve the right to modify, discontinue, or update product specifications, designs, or availability at any time without prior notice.

 

PRICING AND PAYMENT:

 

All prices listed on the Site are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

 

We reserve the right to change prices at any time. The price charged will be the price displayed at the time your order is confirmed.

 

Payment must be completed in full through the payment methods made available on the Site at checkout. We do not store your full payment card details; payments are processed through secure third-party payment gateways.

ORDER ACCEPTANCE:

 

Placing an order on the Site constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability.

 

You will receive an order confirmation via email once your order is accepted. This confirmation does not guarantee product availability in cases of manufacturing delay, which we will communicate to you promptly if it occurs.

 

We currently ship within Worldwide. Estimated delivery timelines will be provided at checkout or via order confirmation, but these are estimates only and not guaranteed delivery dates.

 

Risk of loss or damage to the product passes to you upon delivery to the shipping address provided.

 

Please inspect your order upon delivery. Report any visible shipping damage to us within 12 hours of delivery, along with photographic evidence, so we can assist you.

RETURNS, REFUNDS, AND CANCELLATIONS:

 

Given the handcrafted, made-to-order nature of our products, please review our separate Returns Policy for full details on eligibility, timelines, and process.

 

Products that are damaged upon arrival, defective, or materially not as described are eligible for repair, replacement, or refund at our discretion, subject to verification.

 

Because Oxy Tower contains a living moss component and internal electronics, products that have been misused, overwatered, exposed to conditions outside normal indoor use, or opened/tampered with are not eligible for return or warranty claims.

 

WARRANTY:

 

Oxy Tower's electronic components (including the battery, mist-maker unit, and internal circuitry) are covered by a limited warranty against manufacturing defects for a period of 6 from the date of delivery.

 

This warranty does not cover: normal wear and tear; damage caused by misuse, unauthorized repair, or modification; damage caused by water exposure beyond normal operation; or the natural lifecycle, discoloration, or condition of the living moss component, which requires basic care as outlined in our product care instructions.

 

To make a warranty claim, contact us at the details below with your order number and a description (and photos, where relevant) of the issue.

INTELLECTUAL PROPERTY:

 

All content on this Site including the Oxy Tower name, logo, product designs, photography, and written content is the property of Oxy Tower and is protected by applicable intellectual property laws. This includes design and/or patent applications filed or pending in relation to Oxy Tower's product mechanisms and ornamental features.

 

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

 

Any reference to "patent pending" or "design filed" reflects the status of applications at the time of publication and does not constitute a representation that any patent or design registration has been granted.

 

USER CONDUCT:

 

You agree not to use the Site for any unlawful purpose, to attempt unauthorized access to our systems, to interfere with the Site's operation, or to submit false or misleading information when placing an order.

 

LIMITATION OF LIABILITY:

To the maximum extent permitted by applicable law, Oxy Tower shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to a product shall not exceed the amount paid by you for that product.

 

INDEMNIFICATION:

 

You agree to indemnify and hold Oxy Tower harmless from any claims, damages, or expenses arising from your misuse of the Site or violation of these Terms.

 

GOVERNING LAW AND JURISDICTION:

 

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts in Thane, Maharashtra, India.

 

CHANGES TO THESE TERMS:

 

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
